Subscription Terms and Conditions

§ 1 SUBJECT MATTER OF THE CONTRACT

• • Under the terms and conditions set out in general in the terms and conditions of the online shop (the "Shop Rules") and in particular in these terms and conditions (the "Subscription Rules"), the Subscriber undertakes to purchase - in return for remuneration - an agreed quantity and type of coffee for its use (the "Subscription") and the Seller undertakes to carry out the Subscription with due diligence.
  • In order for the Subscription Agreement (the "Subscription Agreement") to be entered into between the Subscriber and the Seller (collectively, the "Parties"), it is necessary that the Subscriber:
    • confirmed that he is a Consumer;
    • accepted the Subscription Terms and Conditions and the current Shop Rules;
    • selected the quantity and type of coffee from the variants offered by the Seller;
    • chose the frequency of coffee deliveries from among the options provided by the Seller;
    • submitted the Subscription so defined to the Seller using the Subscription form provided by the Seller on the following website: www.storycoffee.pl .
  • For the avoidance of doubt, the provisions of the Subscription Agreement shall apply to the Subscription Agreement and, to the extent not inconsistent therewith, the provisions of the Shop Rules, including those relating to warranty, guarantee and personal data protection.
  • "Subscriber" within the meaning of the Subscription Terms and Conditions is a Customer (within the meaning of § 1 paragraph 4 of the Store Terms and Conditions) who has an active Customer Account (within the meaning of § 1 paragraph 6 of the Store Terms and Conditions), established in accordance with the provisions of the Store Terms and Conditions.
  • Undefined terms in these Subscription Terms and Conditions with capitalised letters have the meaning given to them in the Shop Rules.

§ 2 IMPLEMENTATION OF SUBSCRIPTION

• • On the basis of the Subscription Agreement, the Vendor undertakes to deliver the ordered coffee to the Subscriber every 14 or 30 days (chosen by the Subscriber) to the address indicated in the Customer Account registration form.
  • The customer may indicate a different shipping address at any time, but the indication of a different address must be made two days before payment is collected.
  • Shipping will be carried out up to 48 hours after payment for the subscription period in question has been collected.
  • The cost of shipping is paid by the Customer. This cost is calculated on the basis of the delivery prices indicated on the Order form and the delivery option selected by the Customer. After the Customer has made these selections, these costs shall be added to the amount of the Order in the summary.
  • Proof of purchase in the form of a fiscal receipt or VAT invoice is included with each shipment.
  • Within the framework of the Subscription Agreement, the Subscriber may unilaterally change - any number of times - the type of coffee and also change - any number of times - the quantity of coffee, provided that the subsequent choices are within the variants offered by the Seller at that time. Changes made by the Subscriber shall have immediate effect from their entry through the Customer Account on the website.
  • The subscriber may add other goods from the shop's offer to the subscribed goods at the latest two days before payment is collected. In this case, the subscription amount is increased by the value of the added goods.
  • The Seller undertakes to deliver immediately to the Subscriber - to the Subscriber's email address indicated in the Customer Account registration form - a confirmation of the conclusion of the Subscription Agreement, including a copy of the contents of the Subscription form, the Shop Rules and the Subscription Terms and Conditions, as well as a confirmation of the changes made pursuant to § 2 (2), (6) or (7) above.

§ 3 PRICE

• • The price is payable subject to § 2.6 in the amount resulting from the indications made in the Subscription, taking into account the preferences provided for.
  • Payment for the purchase of a product by subscription can only be made by credit or payment card. This also applies to orders where subscription is one of its components. Price is charged either every 14 days or every 30 days, depending on the Subscription option selected by the Subscriber.
  • The Subscriber agrees that the Payment Provider may cyclically debit from his/her credit or payment card an amount of money corresponding to the value of the subscription service fee (i.e. the amount of money for the purchase of products). The fee will be charged periodically by the Payment Provider in accordance with the shipping frequency selected when placing the order. The credit or payment card will be charged for the order before the products are dispatched.
  • The Subscriber undertakes to provide, in the account indicated when selecting the Cyclical Payment method, sufficient funds to cover the amount due.
  • If the Subscriber fails to provide funds to cover the amount due by the due date, the Payment Operator will make three attempts to collect the amount due.
  • If no collection is possible, the Subscription will not be fulfilled.

§ 4 DURATION

• • The Subscription Agreement shall be concluded on the date of transmission of the Subscription in accordance with § 1.2 above and shall be binding for an indefinite period. The Subscription Agreement may be terminated by the Subscriber for any reason by giving notice no later than 48 hours prior to the collection of the remuneration for the next subscription period.
  • The Subscriber also has the option to suspend the Subscription, no later than 48 hours prior to collection, for subsequent Subscription periods. To continue the Subscription, the Subscriber must, no later than 48 hours before the next Subscription period, cancel the suspension of the Subscription.
  • The Seller may terminate the Subscription Agreement:
    • with at least 30 days' notice, in particular if the vendor has decided to terminate the subscription programme or change its rules;
    • with immediate effect if the Subscriber is at least 14 days in arrears with the payment of remuneration with respect to the due date indicated in clause. 4.1.
  • The declaration of intent to terminate the Subscription Agreement may be made electronically via the Customer Account or using the email addresses indicated respectively in the Customer Account registration form and in clause. 2.2 above.

§ 5 FINAL PROVISIONS

• • The provisions of the Terms and Conditions, which comply in this respect with the provisions of the Consumer Rights Act of 30 May 2014, shall apply mutatis mutandis to the right of withdrawal from the Subscription Agreement. Withdrawal (cancellation) can take place via the Customer Account, where the Subscriber has a button to cancel.
  • The Subscription Rules shall come into force on 29.12.2021.
  • The Seller reserves the right to amend the Subscription Terms and Conditions in particular for the following reasons:
    • a change in generally applicable laws or in the interpretation thereof by authorised bodies, affecting the content of the Subscription Rules and necessitating their adjustment to such change in laws or their interpretation;
    • the issuance of a judgment, decision or other similar act by a court or authorized public authority affecting the content of the Subscription Terms and Conditions and resulting in the need to amend the Subscription Terms and Conditions to conform to such judgment, decision or other similar act;
    • to prevent violations of the Subscription Rules or to prevent abuse;
    • remove ambiguities or doubts of interpretation regarding the content of the Subscription Rules;
    • a technological change in the process of creating or operating a Customer Account or in the purchasing process.
  • The Merchant shall inform the Subscriber of the content of the amendments 7 days prior to the amended Subscription Terms coming into force at the email address indicated in the Customer Account registration form. If the Subscriber does not make a declaration of intent to terminate the Subscription Agreement in accordance with § 4 (1) second sentence above within the aforementioned period, the Subscriber shall be bound by the provisions of the amended Subscription Terms and Conditions.
